(Legally Binding Electronic Agreement)
This Terms and Conditions Agreement ("Agreement") is an electronic record generated under the provisions of the Information Technology Act, 2000 and the rules made thereunder and does not require any physical or digital signature.
This Agreement is entered into between KT Services (OPC) Private Limited (hereinafter referred to as the "Company", which expression shall, unless repugnant to the context, include its successors and permitted assigns), and any person, entity, or body corporate accessing or using the website ktservice.co (hereinafter referred to as the "User").
By accessing, browsing, registering, placing an order, or making any payment through the website, the User irrevocably and unconditionally signifies acceptance of this Agreement and all policies incorporated herein by reference.
Scope of Services
The Company is engaged in the business of providing hospitality, catering, and allied services on a contractual and event-based basis. The precise nature, scope, specifications, timelines, and deliverables of such services shall be governed by quotations, invoices, work orders, proposals, or written communications issued by the Company and accepted by the User.
Formation of Contract
A legally binding and enforceable contract shall be deemed to have come into existence upon successful confirmation of payment through any RBI-authorised electronic payment mechanism, and such payment shall constitute absolute acceptance of the Company's offer without any reservation or qualification.
Pricing, Taxes and Invoicing
All consideration payable by the User is exclusive of applicable taxes unless expressly stated otherwise. Goods and Services Tax shall be levied and collected in accordance with applicable law. Certain services provided by the Company may be classifiable under Service Accounting Code (SAC) 996322, and taxation shall be applied accordingly.
Tax invoices shall be issued in compliance with GST laws. Once issued, invoices shall not be modified, cancelled, or reversed except as expressly permitted under applicable law.
Service Commencement
Service shall be deemed to have commenced upon the occurrence of any preparatory, planning, procurement, logistical, manpower allocation, or execution-related activity undertaken by the Company, whether or not such activity is visible or communicated to the User.
Disclaimer and Limitation of Liability
The Company expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall the Company be liable for any indirect, incidental, consequential, special, or exemplary damages. The Company's aggregate liability, if any, shall be strictly limited to the consideration actually received for the specific service.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. Courts at Palghar, Maharashtra shall have exclusive jurisdiction.
